The following Terms and Conditions of Use form the basis of a legally binding agreement between you and Malaika Adventure Bush Camp Limited, (www.malaikacamp.com, referred to in the text as “Author”, “we” or “us”, as the context requires).

Your use of the www.maikacamp.com website constitutes your acceptance without limitation of the Terms and Conditions. These may be changed by us from time to time at our sole discretion

  1. Content of the online offer

The author assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, which refer to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect and incomplete information, are fundamentally excluded, unless the author can prove that it was intentional or grossly negligent Is at fault. 6. Booking and conclusion of contract

Booking the Malaika Camp is done by email to our email address info@malaikacamp.com The booking and all services as well as agreements, side agreements and special requests are recorded and confirmed in writing.  Travel confirmations will not be sent if the bookings are very short-term.  Liability is excluded for mediated external services that are not the responsibility of the “Malaika Adventure Bush Camp”.

7. Payment of the travel price

After the booking of the Malaika Camp 15% of the travel price is due as a reservation fee. The booking of the camp is only finally confirmed when the deposit has been paid in the first 14 days after the booking is confirmed. When booking through an agency, a 25% deposit is due. The due date is no later than 14 days after the booking confirmation was issued with the invoice. Please note that the booking is only finally confirmed when the deposit has been paid on time.  After completing the booking of a photo safari accompanied by our professional photographer, 30% of the travel price is due as a reservation fee for the appointment.  This includes the booking of domestic flights.  The cost of booked flights will not be reimbursed if the trip is cancelled.  The remaining amount is due for payment four weeks before the start of the trip.  Bookings made within four weeks of the start of the trip oblige the guest to pay the entire travel price immediately.  If you have not booked through a travel agency, but directly with us, please transfer the travel price to one of our accounts.  If we have not received the full travel price on the due date your reservation will be automatically cancelled.  Our prices are shown in US Dollar or in Euro.  The current exchange rates on the payment date.  Malaikacamp.com assumes no liability for any exchange rate losses that result from credit card payments or other transaction costs.

The park fees are charged by the Trans-Mara Country Council and can change at short notice at any time.  The park entrance fees valid on the day of entry must always be paid, regardless of which park entrance fees were stated when the trip was invoiced.

8. Cancellation costs in case of cancellation or postponement

90 – 61 days before arrival 15 % of total costs

60 – 40 days before arrival 30 % of total costs

39 – 22 days before arrival: 50 % of total costs

21 days before arrival or no show: 100 % of total costs

A cancellation fee is also due for individual canceled people, for example if a family/friends tent was booked for 4 people and one person is now deregistered. The cancellation fee will then be calculated pro rata for this person.

Regardless of this, costs that Malaika Camp incurs when the trip is completed, such as for booked domestic flights and hotel accommodation in Nairobi, only refunded or partially refunded in the event of cancellation if the booked company provides for a refund / partial refund upon cancellation.

We always recommend taking out travel cancellation insurance.

9. Travel Requirements

It is your personal responsibility to obtain a valid visa (if necessary) for your entry and stay at the travel destination in accordance with the applicable immigration laws.  Please make sure you have a valid passport for the duration of your trip.

10. Force Majeure

Malaikacamp.com assumes no liability for damage of any kind that results from unforeseeable events or circumstances beyond our control.

11.  Availability

All inquiries about products and services offered on this website are subject to availability. In the case that a product or service you have booked is not available, malaikacamp.com will make every reasonable effort to provide you with an alternative – to offer a product or service of similar price calculation and quality.  If an alternative product or service of a similar price calculation and quality is not acceptable to you or cannot be offered, we will reimburse the travel price you paid to us for the trip.

12. Massive disruptions by the traveller

Malaikacamp.com can terminate the travel contract without notice and immediately if, despite a warning, the guest continues to interfere so much that further participation in the camp is no longer reasonable for the other guests.  This also applies if the traveller does not follow the relevant instructions.

13. Limitation of Liability

The Masai Mara is not a zoo but a large nature reserve with wild animals. In this context, Malaikacamp.com assumes no liability for damage that may occur in relation to your stay in the camp and game drives, unless that malaikacamp.com can be proven to be grossly at fault. The contractual liability of “malaikacamp.com” for damage is limited to double the travel price, insofar as damage was not caused deliberately or through gross negligence or insofar as “malaikacamp.com” is responsible for damage incurred by the traveller solely due to the fault of a service provider. In the case of services that are clearly and expressly designated as mediated, liability is excluded by ”malaikacamp.com”. This applies, for example, to balloon rides. In the case of claims for damages against “malaikacamp.com” resulting from unauthorized acts, which are not due to intent or gross negligence, ”malaikacamp.com” is liable for property damage up to EUR 500.00.  Travel guests are advised to take out travel accident and / or luggage insurance.

The offers and services described on this website and the prices quoted for the camp are subject to change without notice.  Therefore, please check this website regularly for updates and special offers.

15. Place of jurisdiction

All matters relating to the general terms and conditions and terms of use are subject to the law of the Republic of Kenya. The jurisdiction of the courts of Kenya is the sole forum for hearing claims.

16. Severability clause

If individual provisions of these terms and conditions and these terms of use should be ineffective or void for whatever reason based on the applicable law in a country or a country in which these terms of use are considered to be valid, then these invalid or ineffective provisions will become effective to the extent that they are void or ineffective based on the respective jurisdiction, deleted from these terms of use, while all other provisions remain effective and binding.
